Catering Terms & Conditions

1.    Menu selection:

     a.    Penny Lane Catering will supply the Customer with the food and or service, which the Customer has requested in accordance with the Customer Order.
     b.    Penny Lane Catering can recommend the food portions from the menu based on the Customer’s instructions regarding the number of guests and the nature and style of the Customer’s event. 
     c.    Penny Lane Catering reserves the right to change menu items based on seasonal availability on consultation with the Customer.

2.    Customer warranties:

The Customer warrants that: 
     a.    You are authorised to enter into this agreement with Penny Lane Catering for provision of the Catering Service;
     b.    You will inform us if you have any concerns regarding the Catering Service and you will firstly attempt to resolve these concerns directly with Penny Lane Catering.

3.    Quotations:

     a.    Written quotations are valid for 2 weeks from the date of the quotation.

4.    Catering numbers:

     a.    Final guest numbers or portion sizes are not required at the time of booking. The Customer must confirm the quantity of food required including the number of guests who will attend the Customer Event no later than 3 days prior to the event.
     b.    The Customer is responsible for informing Penny Lane Catering of the number of guests at the Customer’s Event for determining food amount. Penny Lane Catering will not be responsible if the food portions which have been supplied in accordance with the customer’s instructions are too much or too little for their event. 
     c.    The Customer cannot decrease the number of guests for determining food quantity after confirmation of final numbers with Penny Lane Catering. Final guest numbers may be increased at Penny Lane Catering’s discretion. Additional charges may apply.
     d.    Invoices are based on the final guest numbers who are catered for at the Customer’s event if this is higher than the Customer Order. If the Customer decreases the quantity of food for an event after Penny Lane Catering has placed its own orders with suppliers for delivery of the Customer’s catering order, then the Customer will pay the quoted price to Penny Lane. 

5.    Delivery & pick-up:

     a.    Delivery and pick-up fees will be included in the final quote. 
     b.    We offer free delivery for the CBD and within the Universities of New South Wales and UTS. The minimum order for orders made directly with Penny Lane Catering by phone or through our web page is $90.
     c.    For other areas within Sydney, other fees and minimum order requirements, apply as follows:

6.    Staff:

     a.    If the Customer orders service for the event, the number of staff and cost will be quoted at the time of booking. 

7.    Breakages and damage:

     a.    All breakages and/or loss of hired or service equipment supplied by Penny Lane Catering to the Customer are the responsibility of the Customer. Breakages or loss of equipment will be charged to the Customer accordingly.

8.    Cancellations & Refunds:

     a.    If the Customer cancels the booking within 48 hours before the Customer’s event, Penny Lane Catering will charge the Customer a cancellation fee of 50% of the Customer order.
     b.    If the Customer cancels within 24 hours of the event, Penny Lane Catering will charge the Customer 100% of the Customer order. 
     c.    If the Customer is not happy with a catering item which has been delivered, please have the event organiser inform Penny Lane Catering by email to or phone promptly after the food has been delivered. In the case of major faults, Penny Lane Catering may refund the cost of or part of the cost of the catering to the Customer. 
     d.    Penny Lane Catering will apply the cancellation policy and refund policy at its discretion.

9.    Final invoice:

     a.    Penny Lane Catering will issue the Customer with an invoice which is payable within 14 days of the date of issue of the invoice. Payment may be made by electronic funds transfer into Penny Lane Catering’s bank account, by cheque or credit card. 
     b.    Penny Lane Catering reserves the right to charge interest at 3% per annum on all outstanding balances from the day after which the payment of the invoice is due.
     c.    Payments made by credit card will incur a credit card surcharge fee.

10.    Liability:

     a.    Penny Lane Catering provides the Customer with the statutory guarantees provided to the Customer under Australian Consumer Law.
     b.    To the extent permissible by law, Penny Lane Catering excludes all express or implied representations, guarantees and warranties relating to Penny Lane Catering’s service except for those set out in the Australian Consumer Law and those which are contained in this agreement. 
     c.    Penny Lane Catering will not be liable for any loss or damage to the Customer of whatever nature which arises out of or in connection with the Customer’s inability to access or use the Catering Services, or in the late supply of the Catering Services.

11.    Force Majeure:

     a.    Penny Lane Catering will not accept any liability for the inability to provide catering pursuant to the Customer order due to strike, lockout, hostilities or any other circumstances outside the control of Penny Lane Catering.

12.    Confirmation:

     a.    Verbal/email confirmation of the quote by the Customer will be taken as acceptance of Penny Lane Catering’s Terms and Conditions.
     b.    This Agreement will be governed by the laws of New South Wales.
     c.    Penny Lane Catering and the Customer irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales.

13.    Disclosure of Personal Information

     a.    The Customer’s Personal Information may be disclosed in several circumstances including the following:
         -    Third parties for the delivery of the catering order;
         -    Where you consent to the use or disclosure; and
         -    Where required or authorised by law.

14.    Definitions:

These Terms and Conditions (Terms) form part of the Agreement between Penny Lane Catering and the Customer for providing the catering service as set out in the Customer Order.
     a.    In these Terms and Conditions Penny Lane Catering ABN 33 625 048 580 means “Penny Lane Catering” (in this contract also referred to as “we”, “our” or “us”). 
“The Customer” means the person, company or business booking the catering service from Penny Lane Catering. In this contract also referred to as ‘You’ and ‘Your’.
     b.    Customer Order” means the final email or Order confirmation which Penny Lane sends to the Customer regarding the food and/or service and the cost of this food and/or service which the Customer is purchasing from Penny Lane Catering.
     c.    Customer’s Event” means date on which the Customer requires the food and or service from Penny Lane Catering.
     d.    Catering Service” is the catering which Penny Lane Catering will provide to the Customer in accordance with the Customer order.
